Aggravated Unlicensed Operation

When the DMV suspends or revokes a motorist's license, they send out several notices. These notices first warn the motorist of any missed court appearances or unpaid fines. Subsequent notices then warn the motorist of the impending suspension. Finally the motorist is sent a notice of the suspension itself.

At that point, if the motorist operates a motor vehicle without clearing up the suspensions or revocations first, they are committing the crime of Aggravated Unlicensed Operation (AUO), under section 511 of the Vehicle and Traffic Law (VTL). There are three subsections of 511.

VTL 511.1 - Aggravated Unlicensed Operation In The Third Degeree

If a motorist operates with one or more suspension or revocation on their license, they are guilty of this subsection. This charge is an unclassified misdemeanor. Conviction carries with it the possibility of incarceration, although this is rare. Typically, the motorist will pay fines, will be forced to clear their license by answering their tickets or paying the outstanding fines. We can usually negotiate a reduction of this charge to a far less serious traffic violation.

VTL 511.2 - Aggravated Unlicensed Operation In The Second Degree

Operating a motor vehicle with three or more suspensions or revocations, originating from three or more separate dates, is a violation of this subsection. It is still a misdemeanor, but is much more serious. Conviction under this section carries with it a mandatory minimum sentence of seven days incarceration, or probation. We can usually negotiate a reduction of this charge to 511.1.

VTL 511.3 - Aggravated Unlicensed Operation In The First Degree

This charge is a felony. When a motorist operates with ten or more suspensions or revocations, originating from ten or more separate dates, they are guilty of violating this section. As a felony, conviction may result in significant incarceration and fines. This is a very serious offense. If you have been charged with this crime, you should contact an attorney immediately.
